SportSongs Terms of Use

1. Acceptance

These Terms of Use govern your use of the SportSongs app provided by Rocky River Software, LLC. By downloading, installing, or using SportSongs, you agree to these terms. If you do not agree, do not use the app.

If you are using SportSongs on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. License

Rocky River Software grants you a limited, non-exclusive, non-transferable, revocable license to use SportSongs for personal, non-commercial use on devices that you own or control, subject to these terms and Apple’s media services terms and conditions.

3. Auto-Renewable Subscriptions

SportSongs Pro is offered as an auto-renewable subscription through Apple’s In-App Purchase system. In the United States, the current plan options are $2.99 per month and $24.99 per year. Pricing may vary by territory, tax treatment, exchange rate, or future App Store pricing updates.

• Payment is charged to your Apple ID account at purchase confirmation.
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account may be charged for renewal within 24 hours before the current period ends.
• You can manage or cancel your subscription at any time in Settings, Apple ID, then Subscriptions.
• Subscription benefits remain available through the end of the active billing period if you cancel.

4. Music Providers

SportSongs works with supported music providers such as Apple Music and Spotify. You are responsible for maintaining any account, subscription, playback rights, or related fees required by your chosen provider.

SportSongs does not sell, license, or provide music content. Spotify features may require the Spotify app and Spotify Premium subscription, subject to Spotify’s terms.

5. User Responsibilities

You agree not to:

• Copy, modify, reverse engineer, decompile, or disassemble the app except as permitted by law.
• Circumvent security measures or use the app to interfere with others’ use.
• Use the app for unlawful, infringing, abusive, or harmful purposes.

6. Privacy

Your use of SportSongs is also governed by the SportSongs Privacy Policy.

7. Termination

We may suspend or terminate your access to SportSongs if you materially violate these terms. You may stop using SportSongs at any time by removing it from your device.

Termination of access does not affect any rights or obligations that accrued before termination.

8. Disclaimer of Warranties

SportSongs is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Rocky River Software is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability arising out of or relating to SportSongs will not exceed the amount you paid for the app subscription during the 12 months preceding the claim.

10. Third-Party Services

SportSongs may integrate with third-party services you choose to use, including Apple Music, Spotify, and ElevenLabs. Those services are governed by their own terms and privacy policies.

• Apple Music playback is handled through Apple’s frameworks and services.
• Spotify playback is handled through Spotify’s APIs and services.
• If you enable ElevenLabs, text-to-speech requests are sent directly from your device to ElevenLabs.

11. Changes to Terms

We may update these terms from time to time. Continued use of SportSongs after updated terms are posted constitutes acceptance of the revised terms.
